Seasonal Maintenance Agreement

The Customer name listed above herein-after referred as the Customer, hereby agrees to Modern Pool Solutions, LLC., (the contractor) Terms and Conditions listed below to set forthh for the complete sewrvice of their pool for the season on the homeowners' property located at the address below:

Modern Pool Solutions, LLC.,

will perform the following tasks to the best of their abilities every week including the pool opening, initial clean-up, and the pool closing, all dates to be determined by the homeowner:
1. Vacuum pool and skim water surface as needed
2. Brush tile, floors, and walls as needed
3. Backwash filtration system as needed
4. Properly clean skimmer and pump baskets
5. Pool equipment inspection to ensure full efficiency
6. Water testing and balancing by adding proper chemicals to provide well-balanced
pool water

In the event that additional service or repairs are required, services will be performed at a labor hourly rate of: $150.00/hour plus the charge of any parts or materials required sold at retail price.
Chemicals are totaled and invoiced at the end of each month.

The services provided will be completed for the following amount of money ($) based on price included in the estimate plus tax (6.625%), but does not include any additional services:.

$2,724.27/season.

1st Payment due with tax (6.625%) the day of pool opening: $908.09
2nd Payment due with tax (6.625%) August 1, 2026: $908.09
3rd Payment due with tax (6.625%) the day of pool closing: $908.09

Cash price: $2,555.00

On behalf of Modern Pool Solutions LLC., I, Rich Manganello accept and will abide by the terms and conditions of this contract.

HOMEOWNER’S RESPONSIBILITY

1. The homeowner represents that he/she is the owner of the real property upon which the swimming pool/spa work is to be performed and that no existing covenants and restrictions hinder the performance of such work.
2. Under any and all circumstances the owner shall furnish and be responsible for the cost related to furnishing water, fuel and power for the services and maintenance of the pool/ spa.
3. It is the owner’s responsibility to obtain any permit and pay any fee that may be required by individual municipalities as a pre-requisite for emptying the pool/ spa. The owner agrees to pay for any fines incurred due to the discharge of water.
4. The homeowner agrees to have the swimming pool/ spa water level at proper operating level to allow filtration system to run at all times. Homeowner will be charged a “Water Fee,” if Modern Pool Solutions LLC must return back to property to manage your water level.
5. The homeowner agrees to have access to outside electric and water and that all equipment must be accessible. Owner agrees to a $125.00 fee if Modern Pool Solutions LLC is prevented from starting or completing scheduled services.

DELAYS

6. Modern Pool Solutions LLC agrees to perform work diligently, but will not be responsible for delay or damages causing failure to perform work due to acts of God, conditions created by the threat of inclement weather, or delays caused by the homeowner not leaving access to the swimming pool/spa.

PAYMENTS & TERMS

7. A finance charge of 10.5% per month will be applied to any invoice outstanding for over 30 days. The
   parties hereto explicitly agree that in the case of default of the terms of this contract by the homeowner; the homeowner will be liable for all costs and expenses of collections, including reasonable attorney’s fees, court costs, disbursements and interest on the unpaid balance at 90% per annum.
8. Deposited checks that are returned by the bank are subject to a $125.00 fee. The terms of this agreement is a single season and may be cancelled by either party in writing.
9. Any and all invoice disputes must be resolved within 15 days of invoice date or charge will be deemed valid.

WARRANTY

10. Modern Pool Solutions LLC warrants that all material used on completing the repair or work contracted herein will be of good quality and the work will be in a competent and workmanlike manner.
11. If any defects occur, Modern Pool Solutions LLC will repair any improper workmanship and replace and repair defective materials without cost to the homeowner, provided the homeowner has notified Modern Pool Solutions LLC of such defects within 1 week after the completion of this service or repair.
12. Equipment, parts, or accessories purchased by Modern Pool Solutions LLC, for use in this service or repair is subject to the manufacturer’s guarantee and warranty.
